Terms of Service

1. Acceptance of Terms

By accessing or using Alert24 ("the Service"), operated by Alert24 ("we", "us", or "our"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree to these terms, do not use the Service.

2. Description of Service

Alert24 provides status page hosting, uptime monitoring, incident management, on-call scheduling, and alerting services. This includes web-based dashboards, public and private status pages (including on custom domains), email notifications, SMS/text message alerts, voice/phone call alerts, push notifications, webhook integrations, a REST API, and related tools.

3. Free Trial

Alert24 may offer a free trial period for paid plans. During the trial, you have access to the features of the applicable plan at no charge. At the end of the trial, your account will automatically convert to a paid subscription unless you cancel or downgrade before the trial expires. We reserve the right to modify or discontinue trial offers at any time.

4. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and API keys. You agree to notify us immediately of any unauthorized use of your account. You are responsible for all activity that occurs under your account, including actions taken by team members or stakeholders you invite.

5. Acceptable Use

You agree to use Alert24 only for lawful purposes. You may not:

  • Use the Service for any illegal or unauthorized purpose
  • Interfere with or disrupt the Service or its infrastructure
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service to send spam, unsolicited messages, or phishing attempts
  • Publish misleading or false information on status pages hosted by Alert24
  • Exceed API rate limits or use the API in a way that degrades service for other users
  • Resell the Service without written authorization

6. SMS and Voice Call Communications

Alert24 offers SMS/text message and voice/phone call notifications as part of our monitoring and alerting service. By opting in to receive these communications from Alert24, you agree to the following:

  • Program Name: Alert24 Status Alerts
  • Message Types: You may receive status change alerts (up/down notifications), incident updates, on-call escalation notifications, scheduled maintenance reminders, and account security notifications via SMS and/or voice call.
  • Message Frequency: Message frequency varies based on the number of monitors you configure and the frequency of status changes. Typical usage ranges from a few messages per week to several per day during active incidents.
  • Message and Data Rates: Message and data rates may apply. Contact your wireless carrier for details about your plan.
  • Opt-In: You consent to receive SMS messages and/or voice calls by providing your phone number and enabling these notifications in your Alert24 account settings.
  • Opt-Out: You may opt out of SMS at any time by replying STOP to any message. You may also disable SMS and voice notifications in your account settings.
  • Help: Reply HELP to any message for assistance, or contact us at [email protected].
  • Consent Not Required for Purchase: Consent to receive SMS messages or voice calls is not a condition of purchasing or using Alert24.

7. Notification Credits

SMS and voice call notifications are subject to a credit-based system. Each plan includes a monthly allotment of SMS and voice call credits. Credits reset at the beginning of each billing cycle and do not roll over. When credits are exhausted, SMS and voice notifications will fall back to push notifications and email until credits are replenished at the next billing cycle. Credit usage and remaining balances are visible in your account settings.

8. API Usage

Alert24 provides a REST API for programmatic access to the Service. API access is subject to the following terms:

  • API keys are confidential credentials. You are responsible for securing your API keys and must not share them publicly.
  • API requests are subject to rate limits. Exceeding rate limits may result in temporary throttling or suspension of API access.
  • You may not use the API to build a competing service or to systematically extract data for purposes unrelated to your use of Alert24.
  • We reserve the right to modify, deprecate, or version the API with reasonable notice.

9. Status Page Hosting and Custom Domains

Alert24 hosts public, private, and internal status pages on your behalf. If you configure a custom domain for your status page, you are responsible for maintaining proper DNS configuration. You are solely responsible for the accuracy and legality of content displayed on your status pages. We reserve the right to remove or disable status pages that violate these Terms or contain objectionable content.

10. Payment and Billing

Paid plans are billed in advance on a monthly or annual basis. Fees are non-refundable except as required by law or unless you cancel during a free trial period. We reserve the right to change pricing with 30 days' notice. Downgrades take effect at the end of the current billing period.

11. Third-Party Integrations

Alert24 integrates with numerous third-party services for monitoring, alerting, and incident management. These integrations are provided for your convenience and may require you to have separate accounts with those third-party providers. We are not responsible for the availability, accuracy, or security of third-party services. Your use of third-party integrations is subject to the respective third party's terms of service and privacy policy. We may add, modify, or discontinue integrations at any time.

12. Data Retention and Export

Alert24 retains your monitoring data, incident history, and related records for the retention period specified in your plan. You may export your data in CSV or PDF format at any time through the Service. Upon account termination, we will retain your data for a reasonable period (no more than 90 days) to allow for recovery, after which it will be permanently deleted. 13. Intellectual Property

All content, trademarks, and data on this site are the property of Alert24 or its licensors. You may not use, copy, or distribute any content without permission. You retain ownership of any data you upload to the Service.

14. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Service is provided on a "best-effort" basis and is not subject to a formal service level agreement (SLA) unless separately agreed in writing. We may perform scheduled maintenance with reasonable notice. We are not liable for any downtime or service interruptions.

15. Limitation of Liability

Alert24 is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to damages arising from missed alerts, delayed notifications, or failure to detect downtime. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

16. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may cancel your account at any time through your account settings. Upon termination, your right to use the Service ceases immediately. See Section 12 for details on data retention after termination.

17. Changes to Terms

We reserve the right to update these Terms at any time. We will notify you of material changes by posting the updated Terms and changing the "Last updated" date. Continued use of the Service constitutes acceptance of the new Terms.

18. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes shall be resolved in the applicable courts.
